The Functions of Fundamental Duties and the Brazilian Constitution of 88

This work outlines what the fundamental constitutional duties set forth in the text of the Brazilian Constitution of 1988 (CF/88) consist of and what the functions of these duties are in the Brazilian legal system. It also highlights some important historical milestones in the construction of the meaning of fundamental human rights, the time and social context in which the term "Fundamental Rights" was coined, as well as when this term was inserted into the Brazilian legal system. Finally, this book also reveals the umbilical relationship between fundamental rights and duties and highlights the dignity of the human person, one of the foundations of the Democratic State of Brazilian Law (Cf. art. 1, III of CF/88).The readers will have the opportunity to know and understand what the author called the Tripartite Theory of Fundamental Rights, as well as why the fundamental duties are a kind of fundamental rights. The work also highlights the close relationship between the fulfillment of the fundamental duties and the effective achievement of the fundamental objectives of the Federative Republic of Brazil.
