Sharing of Profits. A Comparative Study: Common Law vs Shari'ah

Whereas primary objective of establishing a partnership would be sharing profits among its associates, has this element been made a prerequisite under Common Law and the Shari'ah for formation of such a valid joint venture is the main focusing point of the study that analyses the stances adopted by these two diverse legal regimes. So as to get familiarized with the different views espoused by relevant authorities in this regard, the study has attempted by undertaking a comparative analysis between two distinct laws to identify the arrangements envisaged under these principles with the help of the decisions of Common Law jurisdictions and the doctrines of Islamic schools of thought.
