Public-private partnership contracts in Senegal are governed by Law No. 2021-23 of March 2, 2021 on public-private partnership contracts and its implementing decree No. 2021-1443 of October 27, 2021. This law aims, on the one hand, to bring together the different forms of partnership contracts (public and user-pay) in a single legal text and, on the other hand, to ensure the rapid execution of large-scale projects. The major innovations brought by the reform to the current legal framework for PPPs are the following - the unification of the legal and institutional framework of public-private partnerships;- the widening of the scope of application to all forms of public-private partnerships by enshrining definitions that take them into account;- the introduction of tools such as the program agreement, the private initiative offer- positive discrimination in favour of the local private sector for public-private partnerships whose value does not reach a certain threshold to be set by decree.This new framework is designed to facilitate the construction of quality infrastructure.
