PROBLEMS OF LEGAL PLURALISM IN INDIA

Women have always borne the brunt of an unjust and unfair society. Striking the delicate balance between preservation of culture and protection of women¿s human rights has proved to be tricky. India is famous for its culture and tradition in the world. And it is the land of different culture and tradition. An important element of Indian culture is good manners, well-cultured dialogues, religious rites, belief and values. After colonization, countries were determined to restore and preserve their culture. Religious system is also an important part of Indian culture. Religion has an important place in any civilization and culture. All religions have equal protection in the Indian system, which is also provided in the preamble of the Indian Constitution that India will be a secular state. All religion has their personal laws. As we are the inheritor of common law system, we governed by state which imposed state laws for better administration and grievances of citizen. All laws are same but their practices are different, in short the laws of divorce or maintenance. There sarted overlapping of laws due to plurality.
