Proactive Contracting

As today¿s interconnected world has caused a massive expansion in trading relationships across the world, businesses transact across not only physical boundaries, but also cultural and tradition-based boundaries. This ¿journey into the unknown¿ exposes businesses to new risks and weaknesses that can hardly be managed by the traditional mechanisms for creating and managing commercial relationships. It is within this light the proactive approach to contracting has emerged, as potential misunderstandings and disagreements have grown rapidly. As we know that the need and will for a paradigm shift is there, we need to overcome the barriers of traditional contracting, but in the quest of transformation we need tools and mechanisms that ensure a successful journey. It is in this context the foundation of this book emerged. Since the proactive approach to contracting took off, some kind of consensus has been created regarding the tools needed in order to fulfill the transformation from the traditional approach to the proactive approach to contracting. This book elaborate and evolve these tools.
