Position of Ulayat Rights in Acquistion In West Papua

West Papua Province still upholds the existence of customary law which supports the rights of indigenous peoples to land or known as ulayatrights. The dynamics of control, ownership, use, utilization and even relinquishment of customary rights of indigenous peoples on landa are always changing following the pattern of changes in community behavior over the control, ownership, use and utilization of the land. Meanwhile the original customary documentation regarding communal ownership has not yet found the characteristics that can apply historically generally, universally, and are obeyed by the community in a principled manner in Papua. customary law whose existence is recognized in various provinces in Indonesia. This condition is suspected to often create obstacles in the government's efforts to free up these lands for development in the public interest.
