Motivation of judges for the application of house arrest

In compliance with the provisions of the Constitution of the Republic of Ecuador and international conventions ratified by the Ecuadorian State, the Judges of Criminal Guarantees in the exercise of their functions apply the precautionary measure of house arrest in favor of persons who are in a state of vulnerability or who need specialized attention due to their condition; However, this type of measure has been applied without exceptional legal parameters or requirements, this lack of regulations has caused criminal proceedings of public and private knowledge to go unpunished due to evasion or escape of the defendants, who, realizing the lack of security of the homes, see the possibility of evading prosecution and flee the place or violate this restriction of movement. The purpose of this study is to establish the legal, technical and juridical motivation on which the Judges of Criminal Guarantees base their resolutions regarding the application of the precautionary measure of house arrest.
