Marital property agreements and prenuptial agreements

The law grants spouses the opportunity to independently determine their property legal relations through the conclusion of various kinds of contracts and agreements. The emergence in the composition of the property of spouses of new, including non-traditional, objects, along with the introduction into the mechanism of legal regulation of property relations of spouses of new means and ways of regulation, such as the acts of individual legal regulation, needs fundamental theoretical reflection by determining their place and role in the system of single-order phenomena. The mechanism of legal regulation of property relations of spouses can be considered as such a system. In the Russian legal science still lacks a comprehensive characteristic of the mechanism of family legal regulation of property relations of spouses, which would improve both the legislative regulation of relations about matrimonial property and law enforcement practice. Changing the concept of legal regulation of property relations of spouses involves the need to develop scientifically based recommendations for the application of numerous innovations of family law.
