Commercial confidentiality in a market economy is a very important legal institution. At the present time when doing business a lot of information is generated, which is an integral part of successful work. In the century of information technologies the trade secret has become a commodity in the market of business, thereby having fixed its importance in business activity and current Russian legislation.The absolute novelty of regulated relations generates a great number of theoretical problems, which ambiguity causes significant difficulties in their practical application. All this, and the main thing is the lack of judicial practice to protect trade secrets, does not contribute to the spread of the institute of trade secrets in Russia, which in turn has a great impact on the investment attractiveness of the country in the eyes of potential foreign partners.
