Judicial value of evidence in Dominican civil law

Assessment is the judgement to accept the evidential results of an approach. It is the fundamental axis of evidential reasoning, i.e. the reasoning, taking as a starting point the information brought to the proceedings using the means of evidence, to an affirmation of disputed facts presented.The legal system establishes the right to evidence, which requires the application of rules of general epistemology for the evaluation of evidence. This cannot be an operation free of all criteria and loaded with subjectivity, but must be subject to the rules of logic, sound criticism and experience.In terms of facts and judicial reasoning, according to the criteria of Professor Daniel Gonzales Lagier, the evidential facts would constitute the reasons for the argument, the guarantee would be constituted by the maxims of experience, the presumptions and other types of general statements, and the support would be configured by the information necessary to support the guarantee.
