INTER-PARENTAL CHILD ABDUCTION

One of the objectives of this book has been to provide an insight into this unknown crime, the inter-parental abduction of minors, as defined in article 225 bis of the 1995 Criminal Code.Despite the historical background, the truth is that this is an innovative criminal type that was first introduced into our criminal legal system by Organic Law 9/2002 of 10 December amending Organic Law 10/1995 of 23 November on the Criminal Code and the Civil Code on the abduction of minors.As indicated in the Explanatory Memorandum, its purpose is none other than to protect the interests of minors, especially in matters related to their custody, avoiding as far as possible the harmful effects on minor children in cases of family crisis.
