Contours of Judicial Interpretation of Right to Environment in India

India is facing a challenge of balancing the need for economic development and protection of right to clean and healthy environment. The Constitution of India has put two fold duties on the State as well as citizens to protect the environment. Legislative efforts have been made to protect the environment and to deal with majority of the issues related to environment so that the people of the nation get right to clean environment. But the remarkable role has been played by Indian Judiciary in protecting the right to environment. The present paper critically analyses the role of Indian Judiciary protecting the right to environment in India through the interpretation of the Constitutional provisions.
