CENCO's political agreement with the Congolese Constitution of 2006

The political agreement sets up a de facto regime, it simply follows from the fact that it is devoid of legal character, but nevertheless governs the phenomenon of power. In the context of this book, the establishment of a de facto regime results from the change from a constitutional system to a (quasi) a-constitutional or unconstitutional system, which the doctrine identifies under the name of "political coup d'état". In the best case, there is a tumultuous cohabitation between the constitution and the agreement, with the latter often, if not most often, taking over. In the worst case, the former is simply neglected, suspended or abrogated by the latter. The main objective of the Political Agreement of December 31, 2016 was to set up a crisis government composed of the entire political class which is the majority in power, the opposition and civil society for the organization of elections no later than December 31, 2017 totally disconnected from constitutional requirements. In addition, he subjected the parliament to a real chore, consisting of the registration of laws previously established by them.
