Application of the precautionary measures

The Cuban State has been the recipient of the various protectionist proposals that have been presented at the world level with respect to the care and conservation of the environment and, as a result, with the inclusion in the Constitution and the approval of special rules and procedures, environmental law has achieved a leading role within the national system. These rules are not limited to enshrining this right, they are also concerned with guaranteeing its effectiveness through the establishment of suitable administrative and judicial mechanisms for its protection. Precisely the selection of the subject is due to the importance of the precautionary measures regulated in the economic procedure as a procedural institute aimed at achieving effective justice by ensuring in a preventive way the practical result or effectiveness of the main award.
