OHADA Business Law

The purpose of OHADA is ''the harmonization of business law in the StatesParties through the elaboration and adoption of simple, modern common rules adapted to the situation of their economies, through the implementation of appropriate judicial procedures, and through the encouragement of recourse to arbitration for the settlement of contractual disputes''. In this vein, OHADA has already harmonized many matters falling within the scope of business law by adopting ten (10) uniform acts. However, considering the strong legislative activity carried out in competition law in other regional organizations, such as the Economic and Development Community of West African States (ECOWAS), the West African Economic and Monetary Union (UEMOA) and the Economic and Monetary Community of Central Africa (CEMAC), it is surprising that, until now, OHADA has not legislated in competition law. This is the reason for the existence of this publication.
