Lack of insurance

The absence of insurance is understood to be the absence of an insurance contract. Better still, the lack of cover for the loss due to the non-existence of an insurance agreement covering the risk. Understood in this way, it is a worrying reality in the CIMA zone. It is worrying in that it is detrimental to the entire economy in general and to Community nationals in particular.The CIMA Code and internal legislation have provided for solutions to this situation. However, they have so far been insufficient and unsatisfactory. This paper therefore proposes to make a modest contribution to this situation, both in the context of compulsory insurance and uninsurable situations on the one hand, and in the context of optional insurance.
