DEBT COLLECTION PROCEDURE UNDER OHADA LAW

SUMMARYThe purpose of the debt recovery procedure is to specify the rules recommended by the Uniform Act on simplified procedure for debt recovery and enforcement that creditors must observe before courts and tribunals, the prerequisites to which they, lawyers, clerks of the court, bailiffs, notaries and conservators are obliged to submit in order to obtain enforceable titles and proceed with the enforcement. Debt collection, simple in appearance, is in fact full of specific rules set out in the OHADA Uniform Act Organizing Simplified Debt Collection Procedures and Enforcement Measures and involving various participants whose responsibility may be engaged at various times.This book describes the necessary modalities and the procedure to be followed that can be used by creditors to recover their debts in case of non-performance of obligations by their debtors.
