{"product_id":"compliance-with-the-eu-ets-case-study-on-the-german-implementation-von-sophia-kunze","title":"Compliance with the EU ETS","description":"\u003cp\u003eMaster's Thesis from the year 2012 in the subject Law - Miscellaneous, Maastricht University (Faculty of Law), course: Environmental Law, language: English, abstract: [...] Subject of the examination of the paper is the system of enforcement the EU ETS provides in\u003c\/p\u003e\u003cp\u003ethe field of monitoring, reporting and verifying by analyzing the compliance tools and by\u003c\/p\u003e\u003cp\u003etaking the German implementation as an example to review problems and case law of the first\u003c\/p\u003e\u003cp\u003etrading periods.\u003c\/p\u003e\u003cp\u003eSince a sound system of enforcement provided by the EU-ETS to ensure compliance is\u003c\/p\u003e\u003cp\u003eextremely important, the second chapter of this thesis will review the mechanism foreseen in\u003c\/p\u003e\u003cp\u003ethe directive, the so-called compliance cycle, which is based on monitoring, reporting and\u003c\/p\u003e\u003cp\u003everifying; taking into account also the enforcement system¿s unique characteristics in\u003c\/p\u003e\u003cp\u003econtrast to other environmental law instruments. After documenting the obligation of the\u003c\/p\u003e\u003cp\u003eoperators of the installations covered by the directive have, like monitoring and constantly\u003c\/p\u003e\u003cp\u003ereporting on their emission in order to achieve the permission to emit, possibly appearing\u003c\/p\u003e\u003cp\u003eproblems will be shown. Since the member states themselves are in charge of enforcement and therefore control the\u003c\/p\u003e\u003cp\u003eobligations of operators and verifier provided in the Directive 2003\/87 in connection with the\u003c\/p\u003e\u003cp\u003eMonitoring and Reporting Guidelines of the Commission, in the third chapter of this thesis a\u003c\/p\u003e\u003cp\u003ecase study will show how this challenge is implemented practically on the German example.\u003c\/p\u003e\u003cp\u003eMore specifically, after analyzing the framework given by the EU in the Directive 2003\/87, it\u003c\/p\u003e\u003cp\u003ewill be analyzed throughout the third chapter how the German legislator coped with the\u003c\/p\u003e\u003cp\u003echallenge of implementing an effective system and what possible weaknesses are detected.\u003c\/p\u003e\u003cp\u003eMoreover, it will be reviewed what problems the operators have been facing in the first\u003c\/p\u003e\u003cp\u003etrading periods and also how the German authorities dealt with upcoming challenges. Due to\u003c\/p\u003e\u003cp\u003ethe different operators and the different steps within the compliance cycle, different defects at\u003c\/p\u003e\u003cp\u003edifferent levels may appear: incomplete or incorrect data can be forwarded by the installation\u003c\/p\u003e\u003cp\u003eoperators, verification by the private verifier could be biased in favor for one party and\u003c\/p\u003e\u003cp\u003einstallations can emit more than they are allowed to.
